2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. The petitioner seeks bail in connection with Baisi P.S. Case No. 109 of 2021 registered for the offence under Sections 302 and 201 of the Indian Penal Code.

4. Learned counsel for the petitioner submits that the for the death of the deceased Goalpokhar P.S. Case No. 105 of 2021 was registered in West Bengal in which the petitioner was arrested and he has been remanded from that case in the present case.

5. Learned counsel for the petitioner further submits

Patna High Court CR. MISC. No.69378 of 2023(2) dt.01-11-2023 2/2 that for the murder of the deceased, the petitioner cannot be prosecuted in two cases.

6. Learned counsel for the petitioner also submits that the petitioner is in custody since 12.07.2021.

7. Learned A.P.P. has vehemently opposed the prayer for bail.

8. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea in connection with Baisi P.S. Case No. 109 of 2021.
