The petitioner is languishing in custody since 11.04.2016 in a case registered for the offences punishable under sections 8/20(a)(i)/29 of The Narcotic Drugs and Psychotropic Substances Act.

From the shop situated in the house of the petitioner 400 grams of ganja was recovered.

It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Mr. J. N. Thakur, learned APP for the state has not controverted the quantity of recovery.

No.27927 of 2016 (2) dt.05-07-2016 2/2 Considering the small quantity of recovery and the petitioner having no criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Nalanda, Bihar Sharif in connection with Hilsa P.S. Case No.181/2016.
