The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 379 and 504 of the Indian Penal Code. The prosecution case is that on 22.04.2016 the informant had gone to attend the marriage ceremony of his brother at village Shantinagar. The petitioner being the owner of the tent house had also gone in the said marriage. At about 8.30 P.M. some dispute arose with regard to performance of D.J. show when the petitioner called 8 to 10 persons who came armed with hockey stick and lathi, thereafter, they started assaulting the invitee of the marriage. The petitioner also snatched the licensee pistol of the informant.

No.27189 of 2016 (2) dt.05-07-2016 2/2 It is submitted by learned counsel for the petitioner that for petty dispute the accusation has been levelled and there is a counter version of the occurrence also. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The FIR has not been registered under Arms Act and none received any substantial injury.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Agiaon (G) P.S. Case No. 57 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
