Case No. 184 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Sections 3/ 4 of Dine Act.
Prosecution case is that petitioner and other accused persons came and started abusing grandmother of the informant by calling her dine (witch) and there is specific allegation against petitioner that he assaulted her by means of Tengari on several places of her body and later on she succumbed to the injuries.
Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and other co-accused has been granted bail by a co-
Patna High Court CR. MISC. No.58705 of 2019(3) dt.08-01-2020 2/2 ordinate Bench of this Court by order dated 12.3.2019 passed in Cr.Misc.No. 73584 of 2018 and petitioner is in custody since 20.7.2019.
Heard learned APP, who has opposed the prayer for bail on the ground that deceased was an old lady and several injuries were found on her body and there is specific allegation against the petitioner that he assaulted the deceased repeatedly. In view of above facts and circumstances, I am not inclined to grant bail to the petitioner.
Accordingly, this application is dismissed.
However, let the trial be expedited.
