2. The petitioner apprehends his arrest in connection with Chhatapur P.S. Case No. 401 of 2021 registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 427, 504, 506/34 of the Indian Penal Code.

3. As per prosecution case, allegation against the petitioner is that he assaulted the informant by lathi on her head due to which she fell down on the ground after becoming unconscious. He also assaulted the daughter of the informant by Farsa on her head.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. During the investigation Investigating Officer has not

Patna High Court CR. MISC. No.65047 of 2023(2) dt.18-10-2023 2/2 found any complicity of the petitioner but the learned Court below has taken cognizance against the petitioner. Injuries on the injured are simple in nature caused by hard and blunt substance. Petitioner has no criminal antecedent.

5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Chhatapur P.S. Case No. 401 of 2021, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
