====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 17-09-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. In the present case, the petitioners seek bail in connection with Jehanabad P.S. Case No. 212 of 2023, registered for the offences under Sections 395, 411 of the Indian Penal Code.
3. As per the prosecution case, two miscreants riding a motorcycle snatched a bag containing Rs.5 lakh from the informant. The money was withdrawn by the informant from bank. The name of the petitioner transpired during investigation for being involved in this robbery.
4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have

Nothing incriminating has been recovered from person or possession of the petitioners and name of the petitioners transpired during investigation on confessional statement of co-accused Guard Tiwary and except for that confession there is no material to show the complicity of the petitioners in the offences as alleged. The petitioners have not been put to any Test Identification Parade. The co-accused Reena Devi and Gard Tiwary has been granted bail by this Court vide order dated 04.09.2024 passed in Cr. Misc. No. 61920 of 2024 and order dated 04.10.2024 passed in Cr. Misc. No. 70623 of 2024, respectively, by a Co-ordinate Bench of this Court. The petitioners are having antecedent of five cases and they are in custody since 10.02.2025. Charge sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioners. Learned A.P.P. submits that the petitioners are habitual offendors and are accused in similar types of cases.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the submission of charge sheet against the petitioners and their period of custody, the petitioners are directed to be released on
Patna High Court CR. MISC. No.64920 of 2025(2) dt.17-09-2025 3/3 bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-IX, Jehanabad/concerned court, in connection with Jehanabad P.S. Case No. 212 of 2023, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:
(i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
