JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 Petitioners seeks bail in connection with Bahera P. S. Case No. 439 of 2018, registered for the offences punishable under Sections 328, 302, 34 of the Indian Penal Code. As per F.I.R. the daughter of the informant was kept by one Md. Rahman and it is alleged that accused persons and these petitioners have killed her by administering poison. Submissions of the learned counsel for the petitioners is that Md. Rahman has already been granted regular bail by a Co-ordinate Bench of this Court, vide order dated 07.08.2018 passed in Criminal Misc. No. 44752 of 2019 and petitioners are the mother and sister of Md. Rahman. No specific allegation has been attributed against them and the
Patna High Court CR. MISC. No.59486 of 2019(3) dt.20-11-2019 2/2 charge has been framed. They are in custody since 22.07.2019. Heard learned APP for the State also.
Having heard both sides, considering the submissions, made above, this application is allowed. Let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J-II, Benipur, in connection with Bahera P.
