JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 25-10-2024 At the outset, learned counsel for the petitioners submits that the petitioner no. 4, namely, Sanjay Yadav has been arrested during the pendency of the application and as such, he seeks permission to withdraw the bail application of petitioner no. 4.

2. Permission accorded.

3. Accordingly, the application as against the petitioner no. 4, Sanjay Yadav stands dismissed as the same has become infructuous.

4. Heard learned counsel for the petitioner and learned APP for the State.

5. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Amarpur (Fulidumar) P.S. Case no. 393 of 2024 instituted for the offence under Sections 147, 148, 149, 353, 332, 333 and 307 of the Indian Penal Code.

6. The prosecution case is that the police officials saw that one person on a motorcycle was coming there from village Guraydih. On suspicion, he was stopped and after breath analyzer, smell of 'alcohol' was coming out of his mouth. In the meanwhile, group of persons arrived there and they tried to free Ranjit Yadav from the police officials. It is further alleged that Mob started stone pelting due to which one police official received head injury. Accordingly, the FIR.

7. Learned counsel for the petitioners have submitted that petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that on

There is general and omnibus allegation against all the petitioners. Moreover, the petitioners are having no criminal antecedent.

8. Learned APP appearing for the State opposed the prayer of bail of the petitioners.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail (except petitioner no. 4, Sanjay Yadav). The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Amarpur (Fulidumar) P.S. Case no. 393 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
