JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Shastri Nagar P.S. Case No. 100 of 2017, registered for the offence punishable under Sections 399, 402, 120B of the I.P.C. and under Sections 25(1-b)(a), 26 and 35 of the Arms Act. The informant police officer is said to have been received information that some people had assembled in Fakre Plaza Apartment for committing crime. Thereafter, the police personnel reached the said apartment and apprehended the petitioner along with two other persons, carrying one magazine and three cartridges apart from a sum of Rs. 22,550/-. It is further submitted that there is no allegation against the petitioner to commit any crime, although, the aforesaid recovery has been made from his possession. It is also submitted that the petitioner has been falsely implicated in this case and is languishing in jail since 21.02.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-judge-IV, Patna, in connection with Shastri Nagar P.S. Case No. 100 of 2017 (Mohit Kumar Shah, J) khushbu/- U T
