JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Tekari P.S. Case No. 162 of 2017 registered under Section 436 of the Indian Penal Code.

The accusation of informant is that, on 18.04.2017, in the night, house of the informant was burnt, in which, household articles were also burnt to ashes. The informant further alleged that the persons, who indulged in putting the fire, are petitioner nos. 1 to 3, Virendra Yadav, Ramdeo Yadav and Akhilesh Yadav. Learned counsel for the petitioners submits that, in fact, informant is the uncle of the petitioners and he wanted to

Patna High Court Cr.Misc. No.32457 of 2017 (3) dt.10-08-2017 grab the land of the petitioners by constructing the house, regarding which, Tekari P.S. Case No. 43 of 2017 is instituted on the basis of written report of petitioner no. 1 against the informant of the present case due to that reason the present case has been lodged with false allegation. Further submission is that it has come in paragraph 27 of the case diary that fire took place in the house of the informant due to short circuit with the electric wire, which was passing through the house of the informant. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.

10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Gaya, in connection with Tekari P.S. Case No. 162 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
