====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-10-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Warsaliganj P.S. Case No.287 of 2018 registered under Sections 420, 406 and 409 of the Indian Penal Code. The accusation is that the petitioner being the Chairman of Warsaliganj Vyapar Mandal, Nawada, purchased 5642 quintals paddy for the supply of 67% rice to the Bihar State Food Corporation, Nawada, but only 270 quintals rice was sent to the Bihar State Food Corporation, Nawada, out of 3780.14 quintals rice, and the remaining rice (3510.14 quintals) was not supplied to the Bihar State Food Corporation, Nawada.

No.61760 of 2019(2) dt.14-10-2019 2/3 Learned counsel for the petitioner submits that, in fact, the petitioner being the Chairman of Warsaliganj Vyapar Mandal, Nawada, purchased 5642 quintals paddy and the same was given to Aditya Food and Agro Industries for milling and supply of 67% rice but it did not supply the total rice, due to that reason the remaining rice (3510.14 quintals) could not be supplied to the Bihar State Food Corporation, Nawada. Moreover, Manita Priya, Proprietor of Aditya Food and Agro Industries, also admitted about the supply of 5642 quintals paddy for milling by the Warsaliganj Vyapar Mandal and Warsaliganj P.S. Case No.283 of 2018 for the offence under Sections 420, 406 and 409 of the Indian Penal Code was also instituted against Manita Priya, the Proprietor of Aditya Food and Agro Industries, but with an ulterior motive, the present case has also been lodged against the petitioner for not supplying the remaining rice (3510.14 quintals) to the Bihar State Food Corporation, Nawada. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-

Patna High Court CR. MISC. No.61760 of 2019(2) dt.14-10-2019 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Nawada, in connection with Warsaliganj P.S. Case No.287 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
