JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 313,376,372,373/34 and 370-A(2) of the Indian Penal Code and sections 3,4,5 and 6 of Immoral Traffic(Prevention) Act.
The prosecution case is that the informant initially developed intimacy with co accused Ravi Ranjan and got married with him. Ravi Ranjan got the pregnancy of the informant terminated and thereafter Ravi Ranjan left the informant with orchestra group run by the petitioner where she was victimized for flesh trade.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.41086 of 2015 (2) dt.07-10-2015 2/2 that in 164 Cr.P.C. statement the victim has not alleged that she was being used for flesh trade rather she has only stated that she was working with the orchestra group of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Mahila (Motihari) P.S. Case No. 4 of 2015 pending in the court of learned C.J.M. East Champaran, Motihari.
This application is disposed of with the aforesaid observation/direction.
