This is a case registered under sections 341, 323, 353/34 of the Indian Penal Code.

The allegation against the petitioner is that the prisoners were making noise in the cell on which the warden opened the door of the ward and in that course the petitioner fled away towards ward no.1 after pushing the warden. Counsel for the petitioner submits that he has wrongly been implicated in this case. It has been further stated that from perusal of the FIR it could be apparent that no offence is made out under the section under which FIR has been lodged and he is suffering in custody in connection with this case since

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Darbhanga in connection with Laheria Sarai P.S. Case No. 523 of 2016.
