2. The petitioner seeks regular bail in connection with Dumariya Ghat P.S. Case No. 05 of 2018, registered for the offences punishable under Section 394 of the Indian Penal Code.

3. As per the prosecution case, four accused persons assaulted the informant by Fatta and on the point of pistol they looted cash of Rs. 2,00,000 and other articles kept in the bag from the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that there is no recovery from the

He also submits that the similarly situated accused person, namely, Ranjan Kumar @ Pramukh has already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 20.02.2021 passed in Cr. Misc. No. 32632 of 2020. He further submits that the petitioner has two criminal antecedent and he is in jail custody since 22.05.2023.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari or Concerned Court Below in connection with Dumariya Ghat P.S. Case No. 05 of 2018.
