JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-08-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Forest Case No. 15 of 2016, registered under Sections 33, 41, 42 and 52 of the Indian Forest Act.

The accusation is that in course of patrolling duty by the forest officials, one tractor was found loaded with stone chips in its trailer, which belonged to Sonu Gaddi on which Sonu and three unknown were boarded. The stone chips was unloaded near the house of the petitioner and they fled away saying that the said stone chips was purchased by this petitioner.

Learned counsel for the petitioner submits that the driver and others were unloaded the stone chips, which was loaded on the trailer of the tractor, near the house of the petitioner in course of

Patna High Court Cr.Misc. No.33248 of 2016 (2) dt.26-08-2016 2/2 checking by the forest officials and due to some ulterior motive, the name of the petitioner has been implicated in this case. The petitioner having no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in connection with Forest Case No. 15 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
