====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-10-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Parihar P.S. Case No.53 of 2019 registered under Sections 147, 341, 323, 354, 379, 307 and 384/34 of the Indian Penal Code. The accusation is that the petitioners and other F.I.R. named accused due to non payment of ransom of Rs.10,00,000/- by the informant, on 21.03.2019 at about 05.00 P.M, attacked at the house of the informant and, in that course, they damaged the two vehicles of the informant. Thereafter, they armed with country made pistol (Katta), sword, lathi, etc. entered into the house of the informant and started damaging the house of the informant and also snatched the gold chain of the brother of the informant. Patna High Court CR. MISC. No.61767 of 2019(2) dt.15-10-2019 2/2 Suraj Thakur and Baliram Thakur made attack at the informant thrice through country made pistol, whereas Abhishek Thakur made attack at the brother of the informant through country made pistol due to which he sustained injuries.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case and there is case and counter case. Further submission is that the parties have already compromised the case.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Parihar P.S. Case No.53 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
