2. Inspite of putting appearance on behalf of the Complainant/informant by filing Vakalatnama, none is appeared on his behalf.
3. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 406, 467, 468, 471 of the Indian Penal Code.
4. As per FIR, complainant sells total two hundred twenty quintal rise worth rupees five lacs and six thousand to the petitioner and petitioner made assurance to the complainant that payment will be done. After one month complainant told to give the aforesaid amount, the petitioner made excuse and after three months he gave two cheques of rupees fifty thousand and
Patna High Court CR. MISC. No.67979 of 2023(2) dt.06-11-2023 2/3 rupees fifty-four thousand and five hundred but still rupees four lacs one thousand and five hundred due. Complainant repeatedly told to give due rupees but he made forgery and not paid the due amount.
5. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is case and counter case between the parties. He submits that alleged Sections are bailable except Sections 420, 406, 467, 468 of the Indian Penal Code. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.
6. Learned APP for the State opposes the prayer for bail.
7. Considering the facts and circumstances of the case and the fact that the dispute is purely a civil dispute, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Chautham P.S. Case No. 145 of 2023,
