The Petitioner is apprehending his arrest in Sanhaula P.S. Case No. 03 of 2017 registered for the offence punishable under Sections 414 of the Indian Penal Code and Section 7 of the E.C. Act.

The allegation against the petitioner is of blackmarketing the rice of P.D.S. scheme. It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has been falsely implicated in this case and the rice bags which has been seized from the Bullock Cart does not belong to the petitioner. The name of the petitioner has been disclosed by the driver of the

Patna High Court Cr.Misc. No.31959 of 2017 (2) dt.13-07-2017 2/2 Bullock Cart. The petitioner has got no criminal antecedent. Considering the aforesaid facts and circumstances of the case, let the petitioner named above in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Sanhaula P.S. Case No. 03 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
