2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 376, 498(A), 34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

3. As per the prosecution case, this petitioner along with co-accused persons demanded dowry for vidai ceremony, when family member of informant shown their inability to fulfill their demand of dowry, thereafter, the petitioner along with co-accused persons assaulted the informant and her mother, brother.

It is submitted by the counsel for petitioner that petitioner who is mother-in-law of informant, is separate in mess and property and she has got no concern with the family affairs of informant and her husband. Allegation is general and omnibus and no specific overt act has been alleged against this petitioner. Petitioner is an old lady aged about 61 years and she claims clean antecedent.

Considering the facts aforesaid, the petitioner above-named, in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Gaya in connection with Mahila P.S. Case No. 123 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
