====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Biraul P. S. Case No. 100 of 2025 in a case registered for the offences punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita.

3. Prosecution case, in brief, is that co-villager Vijay Paswan informed one Danish that his sister has been killed and dead body is kept in Biraul Hospital. He suspects that all the F.I.R. named accused persons committed murder of the wife of informant.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired during investigation. Only material that has come against

Save and except suspicion, there is no other material available on record to show his complicity in the alleged occurrence. Petitioner claims clean antecedent and is in custody since 05.07.2025. Charge-sheet has already been submitted.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation, clean antecedent and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Biraul, Darbhanga in connection with Biraul P. S. Case No. 100 of 2025.
