JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2017 The petitioner is in custody since 12.03.2017 in connection with Complaint Case No. C-2-230 of 2017, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 226.5 litres of Nepali liquor. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Further petitioner is a cloth vendor and he does his business in delhi. It has also been submitted that petitioner has no criminal antecedent and has been in judicial custody since 14.04.2017 and is ready to abide by any condition imposed on him for grant of bail.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.33064 of 2017 (3) dt.25-07-2017 2/2 Having heard both sides, considering the facts and circumstances of the case, and also that petitioner has no criminal antecedent and has remained in custody for more than three months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.- II- Cum Special Judge, Excise Act, Sitamarhi in connection with Complaint Case No. C-2-230 of 2017.
It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
