2. The petitioner seeks bail registered for the offence under Sections 413, 414, 467, 468 and 471/34 of the Indian Penal Code.

As per the prosecution case, the informant received a secret information that the shop of one Amir Motorcycle located on chopda agency road where stolen motorcycle was selling and buying then the police party reached there then a person saw the police party started to flee away but he was apprehended by the police and he disclosed his name as Md. Javed and some judicial stamps paper have also been recovered from the said shop and thereafter some motorcycle

Patna High Court CR. MISC. No.69895 of 2024(3) dt.14-02-2025 2/2 have also been recovered from other place.

Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next submits that the petitioner is not named in the FIR and he is in custody since 04.05.2024 and similarly situated coaccused has been granted bail by this Court passed in Cr. Misc. No. 19754 of 2024.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

On perusal of the first information report, seizure list and impugned order dated 08.08.2024, it appears that that the petitioner is not named in the FIR and similarly situated co-accused has been granted bail by this Court, in these circumstances, I am inclined to grant bail to the petitioner. Accordingly, let the petitioner, above named, be directed to be released on bail in connection with Civil Line P.S. Case No.10 of 2024 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Gaya.
