Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Section 379 of the Indian Penal Code, registered in connection with Chhauaradano P.S.Case No. 193 of 2019.

A motor-cycle and a mobile set of the informant were stolen away. The case was lodged against unknown. The learned counsel for the petitioner has submitted that he is a poor person and belongs to labourer class. The mobile of the petitioner was stolen away and due to illiteracy and poverty he could not take proper legal recourse in that respect. He has submitted further that his name has figured only

Patna High Court CR. MISC. No.1304 of 2022(2) dt.03-08-2022 2/2 because it was detected that conversation was made from the stolen mobile of the petitioner to the stolen mobile of the informant. The petitioner is a person of clean antecedent. Considering the above facts and circumstances, especially the clean antecedent of the petitioner, let him abovenamed, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul at Motihari, East Champaran in connection with Chhauradano P.S.Case No. 193 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
