The petitioner apprehends his arrest in Dhoraiya (Dhankund) P.S. Case No. 139 of 2015 registered under sections 341, 323, 324, 308, 424, 447, 504, 506, 349 and 379 of the Indian Penal Code pending in the court of Shri P. Chauhan J.M. Ist Clas, Banka.

Allegation against the petitioner is that he assaulted the daughter of the of the informant with axe on her head causing bleeding injury. .

Referring to injury report annexure-2, learned counsel for the petitioner submits that the injury is simple in nature.

Patna High Court Cr.Misc. No.43775 of 2015 (2) dt.14-10-2015 2/2 Since the allegation of assault is against the daughter of the informant, I am not inclined to grant anticipatory bail to the petitioner. The petitioner if so advised may surrender and seek regular bail which shall be considered by the court below on its own merit without being prejudiced by this order preferably on the same day.
