The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on information having been received a raid was conducted and 70 litres of country liquor was recovered. It is stated that the accused persons managed to escape. The petitioner was identified amongst the accused who escaped.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He has no concern with the seized article. The cause of his false

Patna High Court CR. MISC. No.978 of 2022(2) dt.08-06-2022 2/2 implication is his antecedent. He is in custody since 1.9.2021 and investigation in the case is complete.

Having heard learned counsel for the parties and taking into consideration the allegation in the FIR, the petitioner not having been arrested at the spot and having remained in custody for 9 months, the Court directs the petitioner to be enlarged on bail in connection with Rajauli P.S. Case no. 446 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Special Judge, Excise, Nawada.
