The petitioner apprehends his arrest in Aurangabad (Muffasil) P.S. Case No. 232 of 2021, registered for the offences punishable under Section 394 of the Indian Penal Code. As per the prosecution case, three unknown miscreants riding on motorcycle came and one of them assaulted the informant by irod rod. The accused persons also looted the motorcycle of informant.

It is submitted that petitioner is not named in the FIR. Name of petitioner transpired during course of investigation. No stolen article has been recovered from possession of this petitioner. Only on the basis of confessional statement of coaccused Rama Kumar he has been made accused in this case.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Muffasil) P.S. Case No. 232 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
