Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Udwant Nagar P.S. Case No. 365 of 2021, lodged under Sections 323, 302, 504 & 506 of the Indian Penal Code. As per prosecution case, the cause of dispute is due to using of government land for the purpose of putting cow and buffalo on the said land between the brothers. The old mother interfered in the dispute, in which allegation on the petitioner is that, he pushed her mother due to which she sustained injury in the head and after 3 days she died.

Learned counsel for the petitioner submits that the

No.162 of 2022(3) dt.20-10-2022 2/2 alleged occurrence was caused on 15.08.2021 and the deceased died due to injury on 18.08.2021 but the F.I.R. has been lodged on 20.08.2021. Learned counsel for the petitioner further submits that antecedent of petitioner is clean and he is in custody since 01.10.2021.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant Nagar P.S. Case No. 365 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
