The petitioner is in custody in connection with Muzaffarpur Rail P.S. Case No. 56 of 2015 for the offences punishable under Section 401 of the Indian Penal Code.

The petitioner along with some others were charged of planning dacoity on the Railway Platform No.2 at Muzaffarpur Railway Station and the name of the petitioner leading to his arrest is on the basis of a statement made by accused Md. Nausad @ Nepali. It is in consideration of the involvement of the petitioner in one other Rail P.S. Case No.25 of 2015 that his prayer was earlier rejected.

It is stated by Mr. Awadhesh Kumar Singh, learned counsel for the petitioner that the petitioner is in custody since 10.10.2015.

No.33876 of 2016 (2) dt.10-08-2016 2/2 Having heard learned counsel for the parties and considering the circumstances existing in the backdrop of the custodial period, let the petitioner namely, Santosh Kumar Mandal @ Bauwa @ Santosh Kumar be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, Saran at Chapra in connection with Muzaffarpur Rail P.S. Case No. 56 of 2015.
