The present petition has been filed for restoration of C.W.J.C.No.15030 of 2011, which stood dismissed on 24.10.2016 due to non-prosecution. It is evident that on earlier occasion also, the writ petition stood dismissed due to nonprosecution. However, it was restored subsequently. In the present petition, the reason has been assigned for non-appearance that the list was not marked. It was argued by learned counsel for the petitioner that non-appearance was

Patna High Court MJC No.1095 of 2018(3) dt.09-01-2019 2/2 not intentional.

In view of facts and circumstances, restoration petition is allowed.

Let C.W.J.C.No.15030 of 2011 be restored to its original file.
