The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, it is stated that the twelve named accused persons including the petitioner herein variously armed with lathi, spear etc. assaulted Devta Yadav causing grievous injuries.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. There is land dispute between the parties. The allegations are general and omnibus in nature. Co-accused Tufani Yadav, Munshi Yadav, Janardan Yadav and Subash Yadav have been enlarged

Patna High Court CR. MISC. No.998 of 2022(2) dt.09-06-2022 2/2 on bail by different orders which have been brought on record as Annexure-2 series. The petitioner is in custody since 30.9.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegations against the petitioner, the petitioner having remained in custody for 8 months and grant of bail to the above mentioned coaccused vide orders contained in Annexure-2 series, the petitioner is directed to be enlarged on bail in connection with Nadi P.S. Case no. 44 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Bagaha, District West Champaran.
