The petitioner seeks bail in Palanwa P.S. Case No. 57 of 2016 registered under Section 394 of the Indian Penal Code. The accused persons are said to have looted the motorcycle of the informant assaulting him by means of log of tree.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. Nothing incriminating article has been recovered from the conscious physical possession of the petitioner. He was not put on T.I.P. He was remanded in this case from Adapur P.S. Case No. 181 of 2016 and he has been enlarged on bail in the said case. There is nothing on the record to

Patna High Court Cr.Misc. No.33922 of 2017 (2) dt.20-07-2017 2/2 indicate the complicity of the petitioner in the occurrence barring his confessional statement. The petitioner has been languishing in custody since 16.02.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul, East Champaran in connection with Palanwa P.S. Case No. 57 of 2016.
