JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-05-2018 Heard learned counsel for the petitioner and counsel appearing on behalf of the State.

Learned counsel for the petitioner submits that the petitioner on account of various reason is unable to discharge the responsibility and as such he has applied for voluntary retirement. He submitted that the application of the petitioner for voluntary retirement is pending for the last several years. Considering the aforesaid, this writ application is disposed of with the direction to the respondents to examine the claim of the petitioner for voluntary retirement in accordance with Bihar Service Code and take final decision within a period of 60 days

Patna High Court CWJC No.12507 of 2016 (2) dt.03-05-2018 2/2 from the date of receipt of production of a copy of this order. If the petitioner fulfills the condition for grant of voluntary retirement, the respondents are directed to accept resignation in the nature of voluntary retirement forthwith and work out the entitlement of the petitioner with his admissibility on account of acceptance of voluntary retirement within time frame of 60 days.
