JUSTICE RAMESH KUMAR DATTA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner prays for anticipatory bail in a case under Sections 420,406 and 379 of the Indian Penal Code. It is submitted by learned counsel for the petitioner that the petitioner is the owner of Arpan Transport who had been given for transporting the plywood of above Rs. 2 lacs by the informant but the driver of the truck had sold the same away and during the course of investigation the plywood has also been recovered.

It is further submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent and only on account of misdeed of the driver of the truck, he has wrongly

On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Sujit Kumr Mishra, in the event of his arrest/surrender in the court below within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Purnea Sadar (Muffasil) P.S. Case No. 493 of 2014 to the satisfaction of the Chief Judicial Magistrate, Purnea, subject to the other conditions as laid down under Section 438(2) Cr.P.C.
