The petitioner seeks anticipatory bail in Bheldi P.S. Case No.23 of 2015 instituted for the offences under Sections 341,323, 324, 307, 379, 354, 427 and 504/34 of the Indian Penal Code.

It has been alleged that the disputed is with respect to construction of the house. All the accused persons including the petitioner have assaulted the informant. When her wife came for rescue petitioner gave sickle blow causing injury on her left wrist.

In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the

Patna High Court Cr.Misc. No.33722 of 2017 (2) dt.25-07-2017 prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of four weeks from today, the court below will pass an order on its own merit without being prejudiced by the order passed by this Court.
