JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of regular bail arises out of Baniyapur P.S. Case No. 122 of 2014, disclosing offences under Sections 341, 323, 498/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

It appears that the petitioner was earlier granted bail by the order passed by learned Additional Sessions Judge, F.T.C.- V, Saran at Chapra vide order dated 11.07.2014 with the condition that he would appear before the court below on an interval of 15 days for a period of six months. The petitioner is said to have failed to comply the said order inasmuch as he failed to appear with his wife on certain occasions.

Learned counsel for the petitioner submits that if the

No.45979 of 2015 (2) dt.07-10-2015 2/2 petitioner is given an opportunity, he will appear before the court below, as directed by learned Additional Sessions Judge, F.T.C.- V, Saran at Chapra vide order dated 11.07.2014. Taking into account, the fact that the petitioner, after having cancellation of his bail, has remained in custody for more than one month, let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Baniyapur P.S. Case No. 122 of 2014, subject to the condition as laid by the order passed by learned Additional Sessions Judge, F.T.C.-V, Saran at Chapra vide order dated 11.07.2014 in Bail Petition No.

1115 of 2014. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
