JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2022 Heard Mr. Gopal Prasad Roy, the learned counsel for the petitioners and learned APP for the State. Mr. Roy seeks permission to withdraw this application with respect to petitioner no. 1, who has been arrested during the pendency of this application. The application with respect to petitioner no. 1/Bashila Khatoon @ Wasila Khatun @ Vasila Khatun is dismissed as having become infructuous.
The petitioner no. 2 seeks bail in anticipation of her arrest in connection with Dhoraiya P.S. Case No. 106/2021 instituted for the offences under Sections 498(A),
Patna High Court CR. MISC. No.844 of 2022(2) dt.05-04-2022 2/2 323, 504, 506 and 34 of the Indian Penal Code. Regard being had to the fact that the petitioner no. 2 has only been attributed with general and omnibus allegation and that she is the unmarried sister-in-law of the victim, she is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. Case No. 106/2021, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
