2. Learned counsel for respondents Nos. 5 and 6 submits that by way of the supplementary counter affidavit, the questions which have been directed to be answered vide order dated 22.09.2023, have been answered and it has been clarified that two posts earmarked for Extremely Backward Class

Patna High Court CWJC No.3808 of 2018 dt.21-02-2024 2/2 (Female) category were not filled up as only one candidate, Kumari Reena, stands appointed with total marks (average ) of 44.667 against these two posts. For the second question, learned counsel for the respondent submits that the petitioner was not eligible as per the cut-off marks for the Extremely Backward Class (Female) category, and with respect to the third question, he submits that the name of the Extremely Backward Class (Female) appointed is Kumari Renna.

Learned counsel for the petitioner submits that after going through the supplementary counter affidavit filed on behalf of respondent Nos. 5 and 6, it transpires that the name of the petitioner in the merit list is much below and, therefore, selection of the petitioner is not possible and, hence, seeks permission to withdraw the present petition.

4. Permission granted.

5. Accordingly, the present writ petition stands dismissed as withdrawn.
