26-04-2022 Heard learned counsel for the parties.

The petitioner seeks bail in a case registered for the offence under Section 307, 379 and other allied sections of the Indian Penal Code.

As per the prosecution case, while the flood relief material was being distributed in Bariyarpur Covid 19 camp, all the F.I.R. named accused persons reached there, armed with various weapons, and started abusing informant and thereafter, tried to take away the relief material, which was opposed by informant and as such, all started assaulting him. This petitioner is alleged to have inflicted bhala blow on the head of Parsuram Yadav.

It is submitted on behalf of petitioner that injury has been caused by hard & blunt substance and opinion about nature of injury was reserved due to non-availability of X-ray report.

Patna High Court CR. MISC. No.1502 of 2022(3) dt.26-04-2022 2/2 Petitioner has got clean antecedent and he is in custody since 08.06.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody undergone by the petitioner coupled with the fact that petitioner has got clean antecedent, the prayer for bail of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Nautan P.S. Case No. 292 of 2020.
