2. The petitioner seeks bail in connection with S.T. No. 1120 of 2013, arising out of Kotwali P.S. Case No. 242 of 2013 instituted for the offences under Section 302/34 of the Indian Penal Code.

3. As per prosecution case, the accusation against the accused persons including the petitioner is of committing murder of the informant's son by means of sharp blade.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case due to local village politics. He further submits that there is no

There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. He further submits that the main accused is Jacki Ram who has already been granted bail by a Co-ordinate Bench of this Court vide order dated 03.10.2013 passed in Cr. Misc. No. 41242 of 2013. The petitioner has also no concern with the alleged Jacki Ram. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent and is languishing in judicial custody since 23.04.2025 without any rhymes or reason. Other co-accused has been granted bail by this Court vide order dated 09-09-2025, passed in Cr. Misc. No. 40491 of 2025.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature. The Investigating Officer, after completion of investigation, has submitted supplementary charge-sheet against the petitioner finding the case true for offence under Sections Section 302/120(B)/34 of the Indian Penal Code.

6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner, the petitioner having no

No.62344 of 2025(3) dt.26-09-2025 3/3 criminal antecedent, there being no specific allegation against the petitioner as also the prayer for bail being based on parity, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Kotwali P.S. Case No. 242 of 2013.
