02. 15.09.2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.
It is contended on behalf of the petitioners that the victim girl has stated in her statement recorded under Section 164 Cr.P.C. that she had gone on her own sweet-will with Vishnu Sah and they have married and are leading happy conjugal life and has also stated that she is about twenty years of age. It is further contended that the petitioners are the family
Patna High Court Cr.Misc. No.34362 of 2016 (2) dt.15-09-2016 members and they have not played any role in the aforesaid affairs. It is also contended that Vishnu Sah has already been released on regular bail on 11th August, 2016 by the Court below.
Having regard to the facts and circumstances of the case, let the petitioners, namely, Rubi Devi, Dilip Sah and Ranjeet @ Ranjit Sah be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Khagaria (Gangour) P.S. Case No. 97/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
