The instant application for regular bail has been filed by the petitioner instituted for the offence under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code. As per allegation in the FIR, petitioner was appointed as Block Teacher on the basis of forged B.Ed certificate issued by North Orissa Univeristy of Agriculture Technology, Baripada, Orissa.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. After through examination of all the certificates, he was appointed as Niyojit teacher and is still working in Up-graded Middle School,

Patna High Court CR. MISC. No.65164 of 2023(2) dt.12-10-2023 2/2 Gangdwar since 13.08.2010. Petitioner has got no criminal antecedent and languishing in judicial custody since 24.7.2023. Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jhanjharpur, Madhubani in connection with Andhratharhi P.S. Case No. 107 of 2023.
