JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 This is an application for grant of anticipatory bail in connection with Aurangabad Mahila P. S. Case No. 27 of 2019, disclosing offences under Sections 376, 506, 34 of IPC and Section 4 of POCSO Act.

As per F.I.R. there is allegation against one Jitendra Kumar that he committed rape upon the informant and on Hulla, the people assembled, he fled away. So far as this petitioner is concerned, there is allegation that they have threatened the informant not to lodge the case.

Submission of the learned counsel for the petitioners is that there is no allegation of committing rape on the informant against these petitioners. Moreover, the informant has compromised the matter, which will appear from Annexure 2.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-I-cum- Special Judge, POCSO Act, Aurangabad, in connection with Aurangabad Mahila P.
