Patna High Court Cr.Misc. No.49561 of 2015 (3) dt.05-02-2016 05-02-2016 Heard learned counsel for the petitioners and learned counsel for the State.
These petitions are for grant of regular bail in a case under Sections 420, 489B, 489C/34 of the Indian Penal Code and Section 13 of the Unlawful Activities (Prevention) Act, 1967 regarding recovery of huge amount of counterfeit notes. Learned counsel for the petitioner Sanjay Yadav submits that his case is different from two other petitioners as he was not apprehended at the spot.
So far as the petitioners Manoj Yadav and Nandeshwar Sah @ Baba @ Giri @ Narmadeshwar Sah @ Giri Baba @ Sokha Baba are concerned, from their possession huge amount of counterfeit notes were recovered and they have also got criminal antecedent.
Hence, having regard to the facts and circumstances of the case, the petitioners Manoj Yadav, Nandeshwar Sah @ Baba @ Giri @ Narmadeshwar Sah @ Giri Baba @ Sokha Baba and Sanjay Yadav are ordered to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P. S. Case No. 190 of 2015, subject to
Patna High Court Cr.Misc. No.49561 of 2015 (3) dt.05-02-2016 the condition that only petitioners Manoj Yadav and Nandeshwar Sah @ Baba @ Giri @ Narmadeshwar Sah @ Giri Baba @ Sokha Baba will file Hazri in the nearest police station once in fortnight for one year and shall not involve in such type of activity in future and if any report is received regarding involvement then the bail bonds of the petitioners Manoj Yadav and Nandeshwar Sah @ Baba @ Giri @ Narmadeshwar Sah @ Giri Baba @ Sokha Baba shall be cancelled by the Court below.
