JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 395 and 397 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, he was arrested and it is stated that looted articles were recovered from his possession. Learned Sessions Judge, Katihar has mentioned in the impugned order that one looted bed sheet of the informant was recovered from possession of the petitioner.

Learned counsel for the petitioner drew my attention towards photostat copy of the seizure list and submits that the so-

No doubt, petitioner carries criminal antecedent, but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-V, Katihar in connection with Barari P.S. Case No.16 of 2016.
