In Paragraph '7' of the writ application the petitioner has made a specific statement that his petition seeking release of vehicle and rice is pending consideration for a long time in the court below.

In the aforesaid view of the matter, learned counsel for the State submits that a direction may be issued to the learned Sub Divisional Judicial Magistrate, Saharsa to pass an appropriate order on the release application of the petitioner. In the given facts and circumstances of the case, this

Patna High Court CWJC No.18263 of 2019(2) dt.23-10-2019 2/2 Court directs the learned Sub Divisional Judicial Magistrate, Saharsa to consider the application seeking release of the vehicle and rice in question and pass an appropriate order thereon within a period of 30 days from the date of receipt/production of a copy of this order. While passing the order on the release application the learned Sub Divisional Judicial Magistrate, Saharsa shall keep in mind the judicial order of this Court passed in similar matters. The writ application stands disposed off.
