2. The petitioner seeks bail in connection with Harsidhi P.S. Case No. 77 of 2019 registered for the offence under Sections 302, 201 read with 34 of the Indian Penal Code.

3. As per the prosecution case, police recovered a dead body lying near a canal.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the F.I.R. The name of the petitioner has come during investigation on the confessional statement of the co-accused Ranjit Rai. It is further submitted that similarly situated co-accused Ranjeet Rai @ Ranjit Rai @ Ranjeet Kumar Rai has been granted bail by a co-ordinate

Patna High Court CR. MISC. No.71326 of 2023(2) dt.07-11-2023 2/2 Bench of this Court in Cr. Misc. No. 20608 of 2020 vide order dated 06.09.2021.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances of the case, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 21st Additional District Judge, Motihari, East Champaran/concerned Court below in connection with Harsidhi P.S. Case No. 77 of 2019.

8. The petitioner will mark his attendance at the Harsidhi Police Station on first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
