The petitioner is in custody since 11.07.2019 in connection with Town P.S. Case No. 163 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner and he is living separately in other house from where the recovery of alleged wine were made. It is further submitted that the petitioner has no criminal antecedent.
