The petitioner is apprehending his arrest in connection with Makhdumpur P.S.Case No. 199 of 2014 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

From perusal of FIR it appears that there was an agreement between the petitioner and informant for running the informant's R.O. Chilling Plant on lease and for petitioner was given Rs.7,04,600/- but petitioner neither handed over the plant to the informant nor returned back the money.

It has been submitted on behalf of the petitioner that he has paid the entire amount and Rs.1,25,000/- was due to be paid by the informant and further submission is that neither the informant has brought a copy of agreement on record nor he has brought a chit of paper regarding receiving of amount and a false case has been lodged against him for extorting money from him.

Having heard both sides and in view of above facts and circumstances, let the petitioner, named above, surrender in the court below within four weeks from today and on his so surrendering, learned court below will release him on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Mukesh Kumar Mishra, Sub-Divisional Judicial Magistrate, Jehanabad, in connection with Makhdumpur P.S. Case No.

199 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner shall co-operate in the investigation and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of his bail bond and further petitioner will not induce any witness or tamper with the evidence.
