2. The present writ petition is filed for quashing of the order dated 09.10.2012 as contained in Annexure-2 passed by Regional Deputy Director, Health Services, Magadh Division, Gaya in which petitioner's three increment has been stopped and further prayer has been made for directing the respondent authorities not to recover excess amount from the petitioner and other relief which the petitioner is entitled for.
3. Counsel for the petitioner submits that during the
Patna High Court CWJC No.7632 of 2018(4) dt.22-04-2024 2/2 pendency of this writ petition, petitioner has died.
4. Counsel for the State raised preliminary objection that the order of 2012 has been challenged in the year 2018. The effect of the said order was only for three years. As such, this Court is of the view that this case has become infructuous.
5. Accordingly, this writ petition is disposed off with liberty granted to the heirs of the petitioner that in case they have any grievance left, they can move before this Court a afresh.
