JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rajpur P.S. Case No. 131 of 2019, corresponding to N.D.P.S. Case No. 05 of 2019 registered for the offences punishable under Sections 20(i)(b) and 22(c) of N.D.P.S. Act.

As per FIR allegation against the petitioner is that he in collusion with other accused persons got the ganja delivered to the co-accused and on raid in the house of co-accused there was recovery of ganja from the co-accused.

Submission of learned counsel for the petitioner is that except suspicion there is nothing against the petitioner and there is no eye-witness to the occurrence that petitioner was carrying ganja and no other incriminating article has been recovered from his possession.

In view of above facts and circumstances, let petitioner, in the event of surrender within a period of three weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge, Buxar, in connection with Rajpur P.S. Case No. 131 of 2019, corresponding to N.D.P.S. Case No. 05 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
